Terms of Service

English translation provided for convenience. The French version is legally binding and prevails in case of discrepancy.

1. Purpose

These terms of use (the "Terms") set out the conditions under which Noah Hepp (the "Publisher") makes the Outrify application (the "Service") available, and the conditions under which the user (the "User") uses it.

Installing or using the Service means accepting these Terms in full.

2. Description of the Service

Outrify is software installed on the User's computer that automates, on behalf of the online accounts the User owns or is authorised to manage, the search for prospects and the sending of messages according to targeting criteria configured by the User.

The Service requires a user account, an internet connection, and an access key for OpenAI's artificial intelligence API, provided and paid for directly by the User, for the visual analysis of profiles.

3. User account

Access to the Service requires an account linked to a valid email address. The User is responsible for keeping their login details confidential and for any activity carried out from their account.

The User may at any time view, export and delete their account data from Settings → Privacy.

4. Acceptable use and the User's responsibility

The Service is a technical tool: the User alone is responsible for how it is used, in particular for complying with the terms of use of the relevant platform, with the laws that apply to commercial prospecting and to the protection of the personal data of the people contacted (including the GDPR where the User processes data of residents of the European Union), and for holding the necessary authorisations for the accounts used.

The Publisher does not guarantee that use of the Service complies with the terms of use of the relevant platform, which may change independently of the Publisher's will, and disclaims any liability if an account is suspended, limited or closed as a result of using the Service.

It is forbidden to use the Service for unlawful purposes, to harass, to impersonate someone, or to contact people who have explicitly refused any solicitation.

5. Intellectual property

The Service, its code, its interface and its documentation are the exclusive property of Noah Hepp and are protected by intellectual property law. No licence other than a right of personal use of the Service is granted to the User.

6. Availability and changes

The Service is provided "as is". The Publisher endeavours to keep it continuously available but does not guarantee that it will never be interrupted, in particular for maintenance or in case of failure of third-party services (hosting, payment, the platform used).

The Publisher may improve the Service (enhancements, fixes, security updates) without reducing its essential features. Any substantial unfavourable change will be notified at least 30 days in advance; the User may then terminate their subscription and obtain a pro rata refund of the unused period.

In a security emergency, all or part of the Service may be temporarily suspended without notice, for no longer than strictly necessary.

7. Termination

The User may delete their account at any time from Settings → Privacy. The Publisher may suspend or terminate access to the Service in case of breach of these Terms, in particular if abusive or unlawful use is found.

8. Liability

To the extent permitted by law, the Publisher's liability cannot be engaged for any indirect damage resulting from the use of the Service, including the loss of local data stored on the User's device, the suspension of an account, or lost profit.

9. Governing law and disputes

These Terms are governed by French law. Any dispute about their interpretation or performance falls under the jurisdiction of the French courts, unless a mandatory provision applicable to consumers says otherwise.
